This website is operated by Passage LLC (doing business as Passage Fine Art and Brocante-Oregon). Throughout the site, the terms “we”, “us”, and “our” refer to Passage LLC. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

1. Online Store Terms & Age Requirements

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. 2. Nature of Items: Vintage, Antique & Unique Artwork

  • Originality & Condition: The majority of items offered on this site—including original photography, lithographs, framed prints, paintings, and antiques—are vintage or antique pieces. Due to their age, items may exhibit natural age-related wear, patina, foxing, or frame distress.

  • Descriptions & Accuracy: We make every effort to display and describe the colors, details, signatures, and condition reports of our items as accurately as possible. However, actual colors may vary slightly depending on your monitor display settings.

  • Pricing & Availability: All prices are subject to change without notice. We reserve the right at any time to modify or discontinue any item or Service without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of an item.

3. Accuracy of Billing & Account Information

We reserve the right to refuse or limit any order you place with us. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

 

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

 

4. Intellectual Property & Copyright

All original site design, text, custom graphics, and overall visual layout are the property of Passage LLC. Purchasing a physical piece of original artwork, photography print, or antique work from Passage LLC does not transfer intellectual property rights, reproduction rights, or commercial copyright of the underlying artwork to the buyer unless explicitly stated in writing.

5. Third-Party Tools & External Links

We may provide you with access to third-party tools or links to third-party websites (such as payment processing gateways, carrier tracking services, or external marketplaces) over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and ”as available” without any warranties of any kind.

6. Limitation of Liability & Indemnification

In no case shall Passage LLC, our members, officers, employees, affiliates, agents, or contractors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind—including lost profits, lost revenue, lost savings, or replacement costs—arising from your use of any of the service or any products procured using the service.

You agree to indemnify, defend, and hold harmless Passage LLC from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

7. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law principles.
